A ‘Legal Issues Seminar-General IP’ (LIS-GIP) was conducted by Shilpa Margaret Kurian, Associate, on “Can User’s Consent be Deemed as Informed Consent to Share Personal Information?”. The seminar explored concepts of consent, informed consent, informational privacy, and the right to privacy under Article 21 enshrined in the Constitution of India, 1950. The discussion revolved around the nuances of the legal issue by relying on relevant legal provisions under the IT Act, 2000 and IT Rules, 2011 as well as on judicial decisions. The session concluded with interesting questions on the need for informed consent versus consent, the manner in which it may be obtained, and probable guidelines in light of the current framework.
